This adversary proceeding (the “Adversary Proceeding”) was commenced by the filing of a complaint (the “Complaint”) by Martin P. Ochs as Chapter 7 Trustee (the “Trustee” or “Plaintiff’) of the bankruptcy estate of Menachem M. Nemes, the debtor in the above-captioned Chapter 7 case and the defendant in this Adversary Proceeding (the “Debtor”).
