12PIaintiffs appeal the trial court judgment granting defendant’s motion for partial summary judgment. For the following reasons, we affirm.

Facts

In February 2002, plaintiffs, Valerie Griffitt and her husband, John Griffitt, initiated a medical malpractice panel proceeding against A. Jay Binder, M.D., pursuant to the Medical Malpractice Act and La. R.S. 40:1299.41, et seq.
