In this action the appellant and the respondent each claim that she received a plurality of votes cast for the office of county recorder of Salt Lake county, Utah, at the general election held November 4, 1930. The official ballots used at that election in Salt Lake county, Utah, contained four tickets, the Republican, Democratic, Socialist, and Liberty. The name of “Mrs. Helen F. Reiser” appeared upon the Republican ticket. The name of “Miss Jessie Evans” appeared upon the Democratic ticket. The name of “Eleanore Mac-kay” appeared upon the Liberty ticket.
