The respondent herein instituted a proceeding in said court against the appellant, to require it to refund to one E. J. Summerville the sum of eleven dollars, claimed to be an excess over and above, a reasonable compensation, exacted by the appellant from said Summerville, for transporting for him a car-load of wheat from Pendleton to Portland. The respondent, was created by an act of the legislative assembly of the state, entitled “An act to create and establish a board of railroad commissioners, and to define and regulate its powers and duties, and to fix the compensation of its members,”…
