The defendant was the executor of the will of Harriet C. Barnes, late of Pittsford, 'and as such administered upon her estate through the probate court of the district of Rutland. The plaintiff was the residuary legatee under the will. The defendant settled his administration account on July 28, 1925, and on that date the probate court ascertained and adjudged that the residue of the estate consisted of $4,151.93, in money, and decreed the same, less the inheritance tax of $207.59, to the plaintiff.
