On November 15, 1921, the defendant company insured the life of Holmes Allen in the sum of $4,000.00, the policy being made payable to his estate. The insured died on April 3, 1923, and proof of his death, was filed with the company on the 9th day of that month. The company refused to pay the amount of the policy, and this suit was brought by the administrator of the estate of the insured for the purpose of collecting same.
