MEMORANDUM & ORDER

KEVIN THOMAS DUFFY, District Judge:

Petitioner Anthony Costanzo proceeding pro se, seeks a writ of habeas corpus pursuant to 28 U.S.C. § 2255 (1982). On May 21, 1981, Costanzo was convicted after a trial by jury of two counts of wire fraud, three counts of mail fraud, and one count of conspiracy to commit fraud by the United States Court for the Southern District of New York (Gagliardi, J.).
