The plaintiff, appellant, seeks rescission and termination of a contract for the purchase and sale of an apartment property, known as the Delphia Apartments, located at No. 251 South 4th East street, Salt Lake City, Utah. The allegations found in the pleadings and the evidence disclose that the defendant Laura M. Johnson was the owner of the Delphia Apartments; E. H. Johnson was her husband and not otherwise interested in or connected with the interests in litigation; that Mrs. Susan K.
