This is the second time that this case has been in this court. The opinion of the court will be found in 28 Ind. 458, to which we refer for a statement of the case. When this case was here before, the record was very imperfect and defective, but it is now In a much worse condition. A large number of errors, have been assigned and argued, but in consequence of the condition of the record only two or three of them can be considered. We are informed by the clerk that a demurrer was filed and overruled to the second paragraph of the reply, but there is no demurrer in the record, and the clerk…
