RULING ON OBJECTION TO MAGISTRATE’S RECOMMENDED RULING

BLUMENFELD, Senior District Judge.

This is an action under 42 U.S.C. § 1983, in which the plaintiff claims that he was deprived of property and liberty without due process of law. Four of the defendants moved for summary judgment, and United States Magistrate Eagan recommended that the motions be granted. The magistrate held that one of the defendants was not acting under color of state law. As to the three other moving defendants, the magistrate held that they were not in a position to intrude on the plaintiff’s property or liberty…
