OVERTON, J.

Judgment was rendered in the civil district court for the parish of Orleans in favor of plaintiff and against the defendants, Charles Woodward, the owner of real estate in New Orleans, and Lally & Lally, a firm of real estate agents, ordering the firm to return to plaintiff a deposit of $1,000, with legal interest thereon from March 20, 1929, made by plaintiff, under an alleged written offer to purchase from Woodward certain real property in New Orleans for $10,000.
