McNEILL, J..This is an, appeal from the district court of Oklahoma county. The parties will be referred to as they appeared in the trial court. Plaintiff instituted an action upon a policy of life insurance issued by the New York Life Insurance Company dated November 16, 1936, upon the life of Peter G. Weimer, who died on April 28, 1927, said policy being for the sum of $2,000.
The defense to the action on the insurance policy is fraud, concealment, and misrepresentation made by said deceased in his application for the insurance policy in controversy.
