OPINION OF THE COURT

In an action brought in the District Court of the Virgin Islands, the plaintiff, Dora Giurdanella, averred that the defendant, Anthony Giurdanella, her former husband, had breached a property settlement agreement in which he had agreed to make two payments of $2,000 each to her, one on March 16, 1963 and the other on January 16, 1964. The defendant, in answer to interrogatories, admitted having entered into the agreement and claimed that he had paid $900 thereunder.
