Plaintiff Gerard “Tim” Howley was employed by Defendant Federal Express Corporation (“FedEx”) for about twenty years. In 2013, following three disciplinary actions within a 12-month period, Plaintiffs employment was terminated. Plaintiff subsequently sued FedEx pursuant to Michigan’s Elliott-Larsen Civil Rights Act (“ELCRA”), Mich. Comp.
