OPINION REGARDING MOTION FOR SUMMARY JUDGMENT

BROTMAN, District Judge.

In this motor vehicle accident suit, Plaintiff Rocco Branca seeks recovery for non-economic losses as provided under the Automobile Insurance Cost Reduction Act (AICRA), N.J.S.A. § 39:6A-8(a). This matter comes before the Court on Defendant James Matthews’ motion for summary judgment. The Court has diversity jurisdiction pursuant to 28 U.S.C. § 1332(a).
