This matter comes before the Court on plaintiffs motion' for smftmary judgment against the defendants Theresa and Joseph Scott and for default judgment against defendant Dr. David Cohen, docket no. 10, and the defendants Scotts’ cross motion for summary judgment, docket no. 18. The Court heard oral argument on January 29, 1993.
