Woods, Judge:
This action was instituted by the administrator of James Early Bart,ee in the circuit court of Mercer county to recover damages sustained by reason of.injuries to the latter while in the alleged unlawful employment of the Turkey Gap Coal Company. A verdict was returned for plaintiff, and judgment entered thereon. From this judgment the coal company prosecutes error to this Court.
