This was an action in case, in the Circuit Court of St. Clair County, by appellee against appellant, to recover for a personal injury. Trial by jury. Verdict and judgment in favor of appellee for $6,000.

At and prior to the time of the injury complained of, appellant was operating a coal mine in St. Clair county. Appellee was a young man, about nineteen years old, and had worked in the mine for some time. At the time of his injury he was engaged as a “ shoveler,” and his duties were to shovel away the fine coal and dirt made by a mining machine in undercutting the coal. He had been serving in…
