I. INTRODUCTION
This action arises out of the filing of an Abbreviated New Drug Application (“ANDA”) 1 by Mylan Pharmaceuticals, Inc. (“Mylan”), Barr Laboratories, Inc. (“Barr”), Impax Laboratories, Inc. (“Impax”) and Anchen Pharmaceuticals, Inc. (“Anchen”) to market a generic version of the pain drug AMRIX® proprietary to Eurand, Inc. (“Eurand”) and exclusive licensee Anesta AG (“Anesta”) (collectively “plaintiffs”).
