There is evidence in tbe case on appeal tending to show tbat plaintiff was injured while a passenger on defendant’s train, after, sbe bad passed through tbe smoking car into tbe car provided for ladies; tbat before sbe was able to get into a seat sbe was thrown by a sudden and violent jerk of tbe train against tbe iron frame of a seat, and thus injured on ber knee and foot. Her ankle and knee were swollen and enlarged a few days thereafter when sbe was examined by Dr. McCotter. Tbe doctor, introduced by tbe plaintiff as a witness, bad testified tbat be could not determine from bis examination…
