KENNEDY, Circuit Judge.

The Equal Employment Commission (“EEOC”) brought this employment discrimination action on behalf of Stephen Grindle, alleging the Defendant discharged Grindle because of his morbid obesity in violation of the Americans with Disabilities Act of 1990 (“ADA”).
