Appeal by the defendant, the Mutual Reserve Life Insurance Company, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of Westchester on the 4th day of April, 1903, upon the decision of the court rendered after a trial before the court without a jury at the Kings County Trial Term.

The plaintiff has recovered judgment in this State as assignee of seven judgments which were recovered against the defendant in the State of North Carolina upon contracts of life insurance. The defendant is incorporated in this State as a life insurance corporation, and for'many years prior to the 20th day of May, 1899, wap engaged in the life insurance business in North Carolina.
