Springer, J.:

Consuelo Winiarz shot Jacob Winiarz and killed him. She claims that it was an accident, done as part of an April Fools’ routine acted out by Jacob and her on April Fools’ Day and on at least one other occasion prior to the fatal shooting. Consuelo stands convicted of premeditated first degree murder with the use of a deadly weapon and is serving two consecutive sentences of life imprisonment without possibility of parole.
