The defendant, Alfred Thayer, was tried and convicted upon an indictment charging him with robbery. This is a motion for a new trial on the ground that one of the jurors, before whom the case was tried, was disqualified to sit, because he was over the age of seventy years.

It appears that one of the jurors was over the age of seventy years at the time of the trial, and it also appears that that fact was not known to the defendant, or either of his attorneys, until after the rendering of the verdict.
