The defendant was indicted for the crime of perjury. A demurrer to the indictment was filed. Subsequently a motion to dismiss the indictment was made and withdrawn upon the contention being urged that it was necessary that an inspection of the grand jury minutes be had before such a motion would be available. Motion to inspect the minutes was, therefore, made and submitted. The demurrer was argued, and agreement had that this court would pass upon both the demurrer and the motion to inspect the grand jury minutes, a copy of the minutes to be furnished to the judge and the merits of the motion…
