BERRY, Judge.

The appellant was convicted in the District Court of Milam County for the offense of murder and his punishment assessed at confinement in the penitentiary for a term of 25 years.

The facts show that the appellant killed the deceased McAlpine and at the same time and place killed one Junek. The killing occurred at the home of the deceased McAlpine. The appellant, McAlpine and Junek lived in three different houses situated along a certain road in Milam County within an aggregate distance of something like five hundred yards.
