THE COURT.

The complaint in this case alleges that G. W. Woodard, deceased, was during his lifetime, and that plaintiff, as executrix, was at the commencement of this action, the owner in fee and entitled to the possession of section 12, in township 10 north, range 2 east, Mt. Diablo base and meridian. That the defendant was at the time of the commencement of the action in possession thereqf, claiming an interest or estate therein adverse to the plaintiff, which claim is alleged to be without right. Judgment is prayed for the recovery of the possession of the land, and that plaintiff’s title…
