MINTON, Circuit Judge.
The plaintiff-appellee in a complaint ins four paragraphs sued the defendants-appellants for malicious prosecution, false-imprisonment, abuse of process, and conspiracy.
On January 31, 1942, the plaintiff registered at the hotel of the defendant Hotel Sherman, Inc., and at that time represented himself to be the manager of the Mayfair House, Carmel, California, upon which representation he was granted special rates by the Hotel Sherman.
