This action is one of ten cases brought by the Superintendent of Insurance of the State of Ohio to collect an assessment from former policy holders of the Tower Mutual Insurance Company which involve the same legal question and which were submited as a group to the« Court on the second defense of the answer which is identical in all ten cases.

The Tower Mutual Insurance Company, a mutual insurance company, was taken over for liquidation by the Superintendent of Insurance of the State of Ohio on September 10 1938.
