WERLEIN, Justice.

Appellant, W. L. McAdams, sued appel-lee for workman’s compensation benefits for total and permanent disability as a result of an injury alleged to have occurred on August 9, 1962, while working within the course of his employment for Steve’s Construction Company in Galveston County, Texas. In his petition appellant alleged that as a result of the occurrence made the basis of his suit, he received injuries to his stomach and a hernia.
