The bill in this case, filed by Joseph Shepherd, the appellant, on the 9th of October, 184T, states: That Mary Shepherd, the mother of the appellant, was in her lifetime seized and possessed in fee of a certain parcel of land, subject only to the life interest of her husband, John Shepherd, the father of the appellant. That John Shepherd, the father, at his death, under the impression that he was the fee-simple owner thereof, and had a right so to do, devised the same to the appellant.
