BUSH, Judge.
DMS All-Star Joint Venture (DMS) filed its pre-award bid protest complaint in this court on October 28, 2009, challenging the Department of the Army’s proposed award of a contract to intervenor He & I Construction, Inc. (He & I) under Solicitation No. W9124J-06-R-0031. Compl. ¶ 2. This bid protest is now before the court on the parties’ cross motions for judgment on the administrative record.
