*866In an action, inter alia, to recover damages for personal injuries, the plaintiffs appeal, as limited by their brief, from so much of an order of the Supreme Court, Kings County (F. Rivera, J.), dated September 28, 2005, as granted that branch of the defendants’ motion which was for summary judgment dismissing so much of the complaint as sought to recover damages based upon the theory of design defect.

Ordered that the order is affirmed insofar as appealed from, with one bill of costs.
