Defendants Marxer and March appeal from a judgment entered against them and in favor of plaintiff in the sum of $639.56 in an action of assumpsit, containing a count for fraud. The case was tried by the court below without a jury, and judgment entered against appellants on the fraud count, the plaintiff having elected to proceed on that count.
