OPINION AND ORDER

GARCIA-GREGORY, District Judge.

On January 21st, 2005, Plaintiffs filed a Complaint pursuant to 42 U.S.C. § 1981 and § 1983, claiming violations of their Fifth and Fourteenth Amendment rights. On March 24th, 2005, the Commonwealth of Puerto Rico, the Puerto Rico Police Department and Police Officer Modesto Guevarez-Gareia filed a Motion to Dismiss arguing, inter alia, that the Commonwealth and the Police Department are entitled to Eleventh Amendment Immunity, and that all claims against Guevarez-Gar-eia should be dismissed for failure to state a claim under 42 U.S.C. § 1983.…
