LOONEY, Justice.

At a former day, we reversed and remanded this cause for the reason stated later. Tom Rogers, a colored porter in the service of Baker Hotel of Dallas, Inc., sued the Corporation to recover damages, actual and exemplary, for personal injuries alleged to have been received as the result of an unlawful assault upon him by Frank Hickman,' house detective in the service of the Corporation, while acting within the scope of his employment. On submission, the jury found that appellee was assaulted and injured as alleged, found in his favor, damages, actual $250, and exemplary $500,…
