This action arises out of a settlement agreement (“the Agreement”) between the plaintiff, John R. Finn (“Mr. Finn”), and the defendant, Commonwealth of Massachusetts Executive Office of Public Safely and Security, Department of Correction (“Department of Correction”). Mr. Finn seeks the rescission of the Agreement on the grounds of mutual mistake. He now moves for summary judgment pursuant to Mass.R.Civ.P. 56.
