On April 2, 1982, defendant was charged in a three-count indictment with burglary in the first degree, robbery in the second degree and assault in the second degree, stemming from an alleged illegal entry into an apartment at the Woodlake Apartments in the Town of Guilderland at-approximately 9:15 p.m. on March 29, 1982. During the course of this incident, one Edward DeNigris, a guest at the apartment, was beaten and property taken from his person.
