Appeal by the petitioner, William Haydorn, from an order of the Supreme Court, made at the New York Special Term and entered in the office of the clerk of the county of New York on the 13th day of April, 1918, denying his motion for a peremptory writ of mandamus.

Smith, J.:

The plaintiff has been indicted by the grand jury of New York county upon the charge of burglary. He was arraigned in the Court of General Sessions and pleaded “ not guilty,” but “ reserved the right (the Court then and there consenting) *152to withdraw such plea and demur or make any motion on or before March 25th, 1918.” Thereafter he made application to the clerk of the Court of General Sessions to be allowed to inspect the indictment.
