J. H. Giill, an employee of Thomas M. Sessums, a member of the Texas Employers’ Insurance Association, brought this suit to recover compensation under the Workmen’s Compensation Act (Vernon’s Ann. Civ. St. Supp. 1918, art. 5246 — 1 et seq.), for injuries alleged to have been sustained in the course of his employment. This injury was the result of one Salisbury shooting the plaintiff under circumstances hereinafter detailed.
