—Order unanimously modified on the law and as modified affirmed without costs and matter remitted to Supreme Court for further proceedings in accordance with the following Memorandum: In December 1994 defendant and her husband entered into a three-year vehicle lease agreement with plaintiff. Pursuant to the terms of that agreement, plaintiff was entitled to cancel the agreement and repossess the vehicle upon a default in payment, and defendant and her husband would be liable for any balance due as specified in the lease agreement.
