Before the court is a trademark infringement and unfair competition case brought by plaintiff Birthright under the Lanham Act, 15 U.S.C. § 1051 et seq, and the common law. Count I of plaintiff’s second amended complaint states a claim for trademark infringement under Section 32, 15 U.S.C. § 1114.
