In a medical malpractice action, inter alia, to recover damages for wrongful death, the plaintiffs appeal from a judgment of the Supreme Court, Queens County (Lonschein, J.), dated November 8, 1995, which, upon a jury verdict in favor of the defendants Edward T. Davison and Sylvia Berg, in effect, dismissed the complaint insofar as asserted against those defendants.

Ordered that the judgment is reversed, on the law and as a matter of discretion, the complaint is reinstated, and a new trial is granted against the defendants Edward T. Davison and Sylvia Berg, with costs to abide the event.
