J. L. Zumwalt, on March 27, 1920, owned and was operating for hire a federal truck. On that day in crossing the tracks of Chicago, Rock Island & Gulf Railway Company, at a public crossing in the town of Vega, said truck was struck by a passenger train operated by the said railway company and greatly injured and damaged. This suit was brought to recover such damages. There was a trial by jury on special issues. The jury found in response thereto that negligence of the railway company was the proximate cause of the accident; that Zumwalt was not guilty of negligence contributing thereto; that…
