In January, 1937, Max Gruberman was convicted of armed robbery and was sentenced to a term of twenty to forty years in State prison, where he is now confined. More than seven years have passed since he was sentenced. He now moves to set aside the judgment of conviction on the ground that he was denied due process of law within the prohibition of the State and Federal Constitutions. His chief complaint is that the Trial Judge compelled him to proceed to trial with an attorney who was not of his choice and that he was not afforded a sufficient opportunity to prepare his defense.
