INTRODUCTION
The defendants, Teed Welch, et al., as Trustees of Grand Lanark Condominium Trust, filed this motion to dismiss the above-captioned complaint pursuant to Mass.R.Civ.P. 19(a), failure to join an indispensable party. In addition, the defendants filed two motions for summary judgment alleging that some of the defendants were not trustees at the time the plaintiffs’ complaint was filed and that none of the defendants had the authority to enter into a contractual relationship with the plaintiffs.
