In this case, the indictment against the. *287appellant charged, in substance, that on the 1st day of April, 1878, at Bartholomew county, Indiana, he “ did then and there unlawfully sell to one Calvin Butler intoxicating liquor in a less quantity than a quart at a time, to wit, the quantity of two gills of intoxicating liquor, at and for the price of twenty cents, he, the said Peter Wills, not being then and there licensed, according to the laws of the State of Indiana in force at the time, to sell intoxicating liquors at retail in less quantities than a quart at a time, contrary,” etc.
