This case arises out of a truck-pedestrian accident that occurred in Omaha, Nebraska, at about 9 a.m. on May 28, 1986.

At the time of the accident, the plaintiff, Helen R. Kozeny, was walking south through an alley that runs between 23d and 24th Streets. She was on her way to work at Merker Realty Company, whose office is on L Street just west of the alley. The accident occurred when the plaintiff was struck by a pickup truck operated by the defendant, Franklin W. Miller. Miller was backing the truck from a parking stall west of the alley.
