In an action, inter alia, to recover damages for breach of an employment contract and defamation, the defendant appeals, as limited by his brief, from so much of an order of the Supreme Court, Suffolk County (Oliver, J.), dated December 17, 2004, as denied that branch of his motion which was pursuant to CFLR 3211 (a) (7) to dismiss the first cause of action for failure to state a cause of action, and denied those branches of his separate motion which were for summary judgment dismissing the second and third causes of action.
