This is an appeal from a decree of the district court dismissing a bill in equity filed by Employers Liability Assurance Corporation, Limited, as insurance carrier for Walter Brown & Sons, Inc., under tl\e provisions of section 21 (b) of the Longshoremen’s and Harbor Workers’ Compensation Act in force in the District of Columbia (44 Stat. 1424, 1436, 33 U.S. C.A. § 921 (b); 45 Stat. 600, D.C.Codé 1929, T. 19, §§ 11, 12, and 33 U.S.C.A. § 901 note.
